3 Easy Steps for Real Milk Delivery: 

*As KS law states below, the sale of raw dairy products has to happen on-farm.

KDA website states: “Raw milk may sold from the farm where it was produced to the end consumer in Kansas. The sale must take place at the farm where it was produced. Any advertising and any containers used must plainly state that it is raw milk. The raw milk law is found in statute 65-771(w) and says: “On-farm retail sales of milk or milk products” means the sale of milk or milk products on the farm by the producer from the production of the dairy herd to the final consumer. Each container in which any unpasteurized milk is sold or offered for sale shall be clearly labeled as ungraded raw milk.”

Kansas Department of Ag (KDA) interprets “on-farm retail sales” to include delivery if purchases are made online via our storefront but only after coming to the Farm Store first to sign our “Raw Milk Affidavit”.

“Many consumers of raw milk may want the ability to pick up their raw milk at a location other than the farm on which the raw milk is produced. In today’s world of internet sale opportunities, the KDA interprets “on-farm retail sales of raw milk and raw milk products” to include delivery to permanent addresses where routine deliveries are planned to take place designated as “drop-off points,” while still accomplishing the intent of the current law.”

“If it is found that purchasers are not coming to the farm at least once to sign an affidavit stating they have visited the farm in which the raw milk or raw milk products are produced prior to receiving delivery at a drop-off point, KDA may assess a civil penalty of up to $300 to the producer for each transaction found to be out of compliance.”~ KDA
